合同摘要

Article 6General provisions

a. The number of working hours per week is on average 40 hours. The working hours are determined by the Employer and are subject to ongoing assignments. The Employee will work overtime as deemed necessary by the Employer to meet the business needs of the Employer. Overtime will not be paid, but the Employer shall partially allow the Employee to take time off in lieu of the overtime, on the basis of equal time off for the additional hours worked.

Furthermore, the Employee will agree to be very flexible with regard to the working hours and days, such as evenings and even weekends, due to the nature of the company and its assignments. This of course in consultation with the Employer and within reason.

b. The Employee’s normal working hours are Monday, Tuesday, Wednesday, Thursday and Friday from 08:00 to 17:30. The Employee’s working hours can be amended by mutual agreement by both parties, to meet the business needs of the Employer. Overtime must be submitted to and discussed with the Employer on a monthly basis.

c. The Employee is entitled to breaks. In case of a working day of at least 5,5 hours the Employee is entitled to a daily 30-minute break, which can be divided into breaks of at least 15 minutes each if so desired, in consultation with the Employer. The rest break provisions may be excluded or modified, depending on the activities within the company of the Employer. Rest periods that do not comply with the periods stated above will not be recognised as working time and will be deducted from the working hours.  Rest breaks can only be taken on working days and it is not permitted to accumulate breaks that have not been taken. Shifts will be scheduled in such a manner that employees with a full working day have a 30-minute meal break in the afternoon. Break-times shall not be regarded as working time.   The Employee agrees to carry out activities not directly related to the nature of the position, and is willing to work at any location the Employer may provide. Traveling time is not regarded as working time, unless this has been discussed in advance with the Employer. The Employee is obligated to carry out the work according to the instructions and assignments given by the Employer, for which the Employee is expected to actively create new ideas to improve all tasks/processes.

d. The Employee is expected to conduct himself or herself in an honest, ethical and fair manner, in accordance with the applicable laws and regulations and with accepted standards of decency. The Employee will perform his/ her duties to the best of his/ her ability with regard to the provisions of the law, and will contribute as much as possible to achieving the greatest possible structural business success for the benefit of the Employer.

e. By signing this contract the Employee declares to be informed of and agree to the applicable employment and labour rules and regulations as stipulated by the Employer.

6一般规定

a. 平均每周工作时数为40小时。工作时间由雇主确定,并且受持续分配任务的限制。为了满足雇主的业务需求,若雇主认为需要加班,则雇员应进行加班。加班没有加班费,但雇主应“补休时长与加班时长相等”的原则下,视情况批准雇员以补休时间来弥补加班时间。

此外,由于公司的性质及任务的特殊性,雇员同意灵活安排工作时间,例如晚上加班甚至周末加班。当然,一切皆须与雇主协商好,并应确保这种工作安排的合理性。

b. 雇员的正常工作时间为周一、周二、周三、周四和周五的08:0017:30。雇员的工作时间可以通过双方间的共同协议进行修改,以满足雇主的业务需求。加班时间表必须每月提交给雇主并与雇主协商。
c. 雇员享有休息权利。如果每天工作时间至少为5.5小时,雇员有权每天休息30分钟,如需要,可以与雇主协商,以至少15分钟为基础分解休息时间。可根据雇主公司内部的活动情况来取消或修改休息时间。不符合上述时限的休息时间将不被计入工作时间内,并将扣减相应的工作时间作为处罚。休息时间仅限于工作日,不允许累积未休息的休息时间。换班安排为:全天上班的雇员每天下午有30分钟的进餐时间。这一进餐时间不应视为工作时间。雇员同意开展与职位性质无直接关系的活动,并愿意在雇主所指定的任何地点工作。未与雇主提前打招呼而擅自外出的时间不被视为工作时间。雇员有义务按照雇主给出的指示和任务进行工作,并据此积极地提出改进各项任务/流程的新想法。

d. 雇员应按照适用的法律法规和公认的道德标准,以诚实、道德和公平的方式行事。雇员将尽其所能履行其在法律规定方面的职责,并为帮助雇主取得企业结构方面的最大商业成功而付出自己最大的努力。

e. 通过签署本合同,雇员声明已知晓并同意雇主规定的适用雇佣和劳规则和条例。
